What is the subdivision?

The state subdivision legislation provides the legal framework for the subdivision and consolidation of land, easements and restrictions, common property, and creation of owners corporations. All the subdivision and consolidation of land, including buildings and airspace, and for the creation, variation or removal of easements or restrictions should follow the Subdivision Act 1988. The process of subdivision. 

Our conveyancing team helps you with the process of subdivision.

  1. Engage a licensed land surveyor to plan for the subdivision.

  2. Apply for and receive the permit for the development with subdivision through the governmental website Surveying and Planning through Electronic Applications and Referrals (SPEAR).

  3. Submit the subdivision plan for certification. Our team will review the plan under the State Subdivision Act. Once it meets the requirements and accepted by the service authorities, it will be certified.

  4. A statement of compliance will be provided, which states that this subdivision plan has met all the requirements.

  5. The final step is to lodge the certified plan of subdivision and statement of compliance at Land Use Victoria. New titles will then be allowed to be issued for each lot created.
